By signing up as a client of go(123)design you agree to be legally bound by these conditions. go(123)design may change these terms at anytime by updating this posting. You should visit this page periodically to review these conditions, as they are binding to you. go(123)design agrees to award all rights associated with ownership and usage of materials developed by go(123)design to the client upon receipt of approval of the final artwork.
Billing
When you register for the Service, you must pay for the Service via credit card, or other payment method expressly authorized by go(123)design. You will be charged for the Package you have selected. If you pay by credit card, you will be required to provide a valid credit card number and credit card billing address when registering as a Client. go(123)design will email you a receipt for the transactions in which you are involved. Our fee policy for Clients may change and we may decide to impose additional fees on Clients at any time; however, such additional fees will not apply to projects submitted before go(123)design implements any such change in fees.
Payment and Service Terms
Once THE PROJECT has been initiated and PRELIMINARY DESIGNS created, all *retainers &/or other early payments made by CLIENT become non refundable pursuant to the refund policies outlined here. After revision requests have been made by the client, and/or artwork revisions have been executed by go(123)design, and in the unlikely event that go(123)design cannot create a design that THE CLIENT will approve of, THE CLIENT may cancel THE PROJECT in writing at any time. The project then becomes subject to a 'KILL-FEE'. This Kill Fee is an amount not less than 50% of the total amount of THE PROJECT's TOTAL billable amount. Once client has finalized project, and paid remaining balances, go(123)design will prepare appropriate file formats of the final selection and deliver said material to the client. After the project is closed, any additional work on project will be subject to an unarchiving fee. In the event of a ANY job or project cancellation, any artwork created remains the exclusive intellectual property and copyright of go(123)design unless ownership of said property released in writing by go(123)design and the remaining balance of THE PROJECT's billable amount is remitted. Also, if THE PROJECT retainer payment was submitted via any credit card service, THE PROJECT is also subject to a $45 administration and service fee should the project be cancelled, for any reason, by the client, prior to approval and/or completion. Any billing dispute must be submitted to our Customer Service Department.
Project Scope
No further changes in the PROJECT scope may be requested by THE CLIENT, after PRELIMINARY DESIGNS have been presented. Such changes include, but are not limited to, company name and/or type of business. Such changes require a new PROJECT submission (project brief) and the creation of a new set of PRELIMINARY designs. REVISIONS (outlined in order details) of any PRELIMINARY design must be within the original scope of the PROJECT brief as submitted to go(123)design, by THE CLIENT, prior to presentation of PRELIMINARY DESIGNS. Any public publishing of PRELIMINARY DESIGNS or REVISIONS by THE CLIENT, or if THE CLIENT makes said web site available on the 'World Wide Web' (THE INTERNET) through placing of any PRELIMINARY or REVISIONS artwork on a server other than go(123)design preview server, and making this IP address available to Internet traffic, constitutes FULL acceptance of ANY and ALL material related to THE PROJECT. Client agrees to pay ALL remaining balances at that time. Any further edits, or revisions to THE PROJECT will be subject to additional hourly billings and/or charges to THE CLIENT, as outlined in our current pricing lists.
In the course of THE PROJECT, go(123)design will remain in contact with the client regarding edits, revisions and scheduling. If THE CLIENT fails to provide necessary feedback to go(123)design regarding any edits and/or revisions within 15 work days, THE PROJECT may be subject to removal from our servers and placement in our STALE DATED database. Any STALE DATED project is subject to a $75 ($US) reactivation and unarchiving fee. This fee is at the sole discretion of go(123)design On restart THE PROJECT, any deliverables will be subject to the terms of the package originally ordered, but deliverables of said PROJECT will be subject to the most current version of the package as listed on our web site. If deliverables advertised in a manner other than our web site, vary from the details listed on our web site, the descriptions featured on or web site (www.go(123)design.com) shall be considered correct.
If THE CLIENT fails to communicate with go(123)design regarding any initiated project for a period of more than 30 days, such project will be canceled, and any retainers or deposits shall be applied as a KILL-FEE as outlined elsewhere in this document. No further edits, revisions, file transmission or online image storage will be undertaken by go(123)design after that date. Further activation of this project will be subject to new project activation, project submission, retainers and deposits as outlined in our current pricing schedules, unless specifically waived, in writing by an authorized representative of go(123)design.
Further, if THE CLIENT, after 60 days from project submission, and after initial preliminary designs have been displayed, wishes to alter original scope of project, as outlined in project submission forms, including, but not limited to, name change, type of business change, theme of business change, specifically requested illustration change, then such project shall be deemed a new project and subject to new retainer payments as per current pricing schedules. Previously paid retainers and/or balances shall be applied as KILL FEES to original project, and any new retainers and/or balances shall be applied to new project as requested by THE CLIENT.
Project 'work product' and unused material/designs.
All artwork, designs, edits, revisions and work product created in THE PROJECT (other than the FINAL design accepted by THE CLIENT as being the subject of this agreement) remain the exclusive copyright and intellectual property of go(123)design Any use of this work project by THE CLIENT and/or their assigns is strictly prohibited without written, prior permission by go(123)design
go(123)design is NOT liable for any damages or expenses incurred by the client in the use of artwork created in THE PROJECT by third parties, unless said third party is contracted by go(123)design as a 'work-for-hire' vendor, or in direct professional consultation with go(123)design Such consultation is subject to fees as agreed to by THE CLIENT and go(123)design By contracting go(123)design to create THE PROJECT as outlined in these terms and conditions THE CLIENT agrees to abide by the terms and conditions contained therein. Removal and Refusal of Service
You acknowledge and agree that go(123)design shall have the right (but not the obligation) in its sole discretion, to pre-screen, refuse or remove any project and/or user provided content that violates these Terms and Conditions or is otherwise objectionable, including, without limitation, projects or content that is illegal, obscene, indecent, defamatory, incites religious, racial or ethnic hatred, or violates the rights of others. Activity that is brought to our attention which appears in our sole judgment to violate the law will be brought to the attention of the proper authorities. You acknowledge, consent and agree that go(123)design may access, preserve, and disclose your account information and content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce these Terms and Conditions; (c) respond to claims that any content violates the rights of third-parties; (d) respond to your requests for customer service; or (e) protect the rights, property, or personal safety of go(123)design, its users and the public.
Refund Policy
go(123)design is committed to developing a design solution for you that you will be completely satisfied with. Once you have requested your first round of revisions, you will no longer be eligible for a refund. However, if you are not happy with the design solutions, depending on how deep we are into the design development process and after discussing your concerns with will negotiate a refund at this time or we will supply you with a new set of concepts at new negotiated fee or up-charge. Should you receive a refund, you agree that your acceptance of the refund shall constitute your sole and exclusive remedy with respect to related Responses. Additionally, you acknowledge that you will have no right (express or implied) to use any concept or other work product, content, or media, nor will you have any ownership interest in or to the same.
Ownership/Copyrights
Ownership of the final artwork becomes the property of the client, having unlimited, indefinite, and royalty-free use of artwork upon approval of the final draft. go(123)design retains rights to display the artwork in portfolio and advertising materials. All concepts or any preliminary materials which are not selected by the client or are not included in the final delivery, remain the full property of go(123)design
Delivery of Initial Concepts
1. All interaction occurs over the internet. This does not mean that we are not available by phone. In fact we encourage our clients to call during normal business hours 8AM to 5PM Mountain Standard Time. This simply means that concepts are sent via email, revisions must be submitted through the client center (link will be provided), and electronic files of your design solutions will be delivered via email unless otherwise requested.
2. Order confirmation will be sent to you by email confirming the immediate start of the project within 1-3 business days. Orders are confirmed only after receipt of completed order form and payment confirmation.
3. Initial concept delivery is typically within 4-7 business days of the order confirmation depending on which package you purchased.
*Some projects are completed within a matter of days while others may take months to complete. Guaranteed 1 business day service may be available for an additional fee.
Revisions
1. Interaction occurs over the internet.
2. Revision requests shall be submitted through your online account center. Revisions cycles are predetermined by your order and any additional versions of an original concept that incorporate any specific changes requested by the client. The purpose of the revision process is to form and mold the concept we created for you based on the information you provided us into what you the client determines. Client's requests shall be modifications of one chosen concept only. Revision requests that depart from the current composition and require major graphical changes, will be honored and completed in a timely manner set forth by these terms and conditions. However, go(123)design reserves the right to charge $50 for each such revision. No revision work which requires payment will be started without authorization from the client.
3. Revision cycles typically take a minimum of 3-5 business days to complete. 4. You agree to provide timely responses to any status notifications that go(123)design sends to you. You shall have 15 days to respond to each Response sent to you. If after 15 days you have failed to respond, go(123)design will assume that your project is complete and the project shall be deemed completed. At such time, go(123)design will have no further obligation to you. Notwithstanding the foregoing, go(123)design n reserves the right, in its sole discretion, to terminate your access to all or a portion of the Service, at any time, with or without notice. In the event of such termination, go(123)design will determine, in its sole discretion, whether you are entitled to any refund. (A $25 reactivation fee will apply)
Final Deliveries
1. Upon completion of your project, your final files will be sent via email for immediate use.
2. You will receive your logo files (color & black & white) in a vector format (AI, EPS) and high resolution TIFF(print-ready) and in to web-ready file formats (JPEG, GIFF). Additional files are available upon request.
3. The files will be uploaded to your account for download.
Additional Work
Should the client require additional services beyond the scope of the package purchased (either concurrently with the project or at a later date), the client will be provided with a price list for such changes. Additional work will be done after pre-paying add on services in full.
Use of Member Account
The client can access their registered accounts by signing in on our homepage.
Once signed in, the client has access to their previous lists and information that they have submitted to the site.
Users can update their information once they have logged in to their accounts by clicking My Account.
Trademarks
The trademarks and logos displayed on go(123)design.com are the property of go(123)design. You are not permitted to use these without the prior written consent of go(123)design. go(123)design and the go(123)design logo are trademarks of go(123)design.
Notification of the Changes in Terms of Service
go(123)design reserves the right to modify this terms and conditions at any point of time, without prior notice. Thus it is advised to review the terms and conditions frequently. If we make material changes to this policy, we will notify you here, by email, or by means of a notice on our homepage.
